Terms of Service for Lightning Apps

The following Terms of Service (“Terms”) apply to your use of the Lightning Apps monday.com marketplace applications or any products or services developed and owned by Lightning Apps (“we” or “us”). By using Lightning Apps, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use Lightning Apps products or services.

Use of Lightning Apps

You may use Lightning Apps only for lawful purposes and in accordance with these Terms. You agree not to use Lightning Apps:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• To engage in any activity that interferes with or disrupts Lightning Apps or the servers and networks used to operate Lightning Apps.
• To transmit any unsolicited or unauthorized advertising, promotional materials, or spam.
• To impersonate or attempt to impersonate Lightning Apps, a Lightning Apps employee, or another user.

Intellectual Property

Lightning Apps and its entire set of products, services, contents, features, and functionality are owned by Lightning Apps or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of Lightning Apps without our prior written consent.

Warranty Disclaimer

Lightning Apps is provided “as is” and “as available” without any warranties of any kind, either express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Lightning Apps will be error-free or uninterrupted.

Limitation of Liability

In no event shall Lightning Apps, its affiliates, or their respective directors, officers, employees, or agents be liable for any indirect, consequential, special, or punitive damages, including, without limitation, lost profits, arising out of or in connection with the use or inability to use Lightning Apps.

Indemnification

You agree to indemnify and hold Lightning Apps, its affiliates, and their respective directors, officers, employees, and agents harmless from any claims, liabilities, damages, and expenses, including reasonable attorneys’ fees and costs, arising out of or in connection with your use of Lightning Apps or any violation of these Terms.

Termination

We may terminate your access to Lightning Apps at any time and for any reason, without notice or liability. Upon termination, all provisions of these Terms that by their nature should survive will survive, including, without limitation, intellectual property, warranty disclaimer, limitation of liability, indemnification, and dispute resolution.

Governing Law

These Terms will be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Changes to These Terms

We may update these Terms from time to time. If we make any material changes to these Terms, we will notify you by email or by posting a notice on the Lightning Apps website.

Billing, Payment, and Renewal

Some of our Services are offered for a fee. By using a Paid Service, you agree to pay the specified fees. For recurring services, we’ll bill or charge you in the automatically-renewing interval (such as monthly or annually) until you cancel, which you can do at any time. You must notify us if you intend to cancel before the renewal date.

Refunds

We may have a refund policy for some of our Paid Services, and we’ll provide refunds if required by law. Otherwise, there are no refunds and all payments are final.

Feedback

We love hearing from you and are always looking to improve our Services. When you share comments, ideas, or feedback with us, you agree that we’re free to use them without any restriction or compensation to you.

Lightning Apps is provided “as is”. Lightning Apps and its partners and suppliers disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

In no event will Lightning Apps or its partners or suppliers be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability, or other legal or equitable theory.
